2012 Club Macanudo Weekend in NYC Sweepstakes Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN ALASKA, HAWAII, VIRGINIA, MICHIGAN, AND MASSACHUSETTS, AND WHERE PROHIBITED BY LAW OR REGULATION.

1. ELIGIBILITY: The Club Macanudo Weekend in NYC Sweepstakes ("Sweepstakes") begins at 12:00:01 am ET on 1/1/12 and ends at 11:59 pm ET on 2/29/12 ("Sweepstakes Period"). Sweepstakes is open to: (i) legal residents of the continental United States and D.C., (except for residents of Alaska, Hawaii, Virginia, Michigan, and Massachusetts are ineligible to participate) and (ii) who are twenty-one (21) years of age or older. Void where prohibited by law. Employees of Sponsor and its affiliates, subsidiaries, wholesalers, distributors, retailers, sales representatives, advertising, promotion and judging agencies and the immediate family members (parent, child, spouse, and sibling) and persons living in the households of each are not eligible to enter the Sweepstakes.

2. HOW TO ENTER: During the Sweepstakes Period, you will be automatically entered into the Sweepstakes each time you purchase a box of Macanudo cigars from JR Cigars. Alternatively, you can enter by hand-printing your name, complete home address, daytime phone number, date of birth and the words "Club Macanudo Weekend" on a 3" x 5" card. Mail the 3"x 5" card to "Club Macanudo Weekend Entry", 2589 Eric Lane, Burlington, NC 27215. Each 3"x 5" card must be submitted in a separate, hand-addressed, stamped envelope. IMPORTANT: All mail-in entries must be postmarked by 2/29/12 and received by 3/9/12. No responsibility is assumed for lost, late, mutilated, incomplete, illegible, misdirected or postage due entries and such entries will be void. All entries become the property of the Sponsor and will not be returned or acknowledged.

3. WINNER SELECTION: One (1) Grand Prize winner will be selected in a random drawing conducted on or about 3/9/12. Each drawing will be from among all eligible entries received during the Sweepstakes Period. The Grand Prize winner will be notified by phone call, email or a traceable, delivery service on or about 3/14/12. Random drawing will be conducted by JR Cigars, whose decisions are final and binding in all matters relating to this Sweepstakes.

4. PRIZES (1): Grand Prize: A 3-day/2-night weekend trip to New York City for winner and guest. Grand Prize consists of round trip coach air transportation for winner and guest from the major commercial airport nearest Grand Prize winner's residence to New York City, two (2) nights standard hotel accommodations (one room, double occupancy), all meals and ground transportation to and from NYC airport. Winner and guest will be have dinner at Club Macanudo, and see a Broadway show (show will be determined based on availability at time of trip). Approximate retail value (ARV) of Grand Prize trip: $4,000. The actual value may vary based on winner's point of departure and airfare fluctuations. Any difference between the estimated value and the actual value will not be awarded. All other expenses on the receipt and use of the prize not specifically mentioned herein, including but not limited to tips, gratuities, additional meals, beverages, and other miscellaneous expenses, are solely the responsibility of winner and his/her guest. All Grand Prize winner travel must be completed by 03/01/13. In the event of non-compliance with any requirement in these Official Rules, or if the chosen winner is not available for travel on the dates designated by Sponsor, prize will be forfeited and may be awarded to an alternate winner, time permitting. Other restrictions may apply. No responsibility is assumed for cancelled, delayed, suspended or rescheduled events (including airline flights beyond its control). Grand Prize winner is solely responsible for obtaining all necessary identification required to travel. Major credit card will be required upon hotel check in to cover any incidental charges incurred by winner and/or guest. Travel arrangements and accommodations are subject to availability, government restrictions and regulations, airport or other transportation terminal or other types of transportation restrictions and regulations. Other restrictions may apply. Any portion of this prize not accepted by Grand Prize winner will be forfeited. Prize is non-transferable and no cash equivalent or substitution of Grand Prize is offered, except at the sole discretion of the Sponsor. Odds of winning a Grand Prize depends on the number of eligible entries received during the Promotion Period for that drawing.

5. GENERAL CONDITIONS: Sweepstakes entrants agree to be bound by the terms of these Official Rules. Sweepstakes is subject to applicable federal, state and local laws and regulations, and is void in AK, HI, MA, MI, VA, and where prohibited. Potential Prize winners must sign and return an Affidavit of Eligibility, a Liability Release and, where permitted, a Publicity Release within seven (7) days from the date on the written prize notification letter or prize will be forfeited and awarded to an alternate winner. Failure to comply with these requirements for any reason, or return of the prize notification letter as undeliverable or refused, may result in disqualification and selection of an alternate winner. Prize winner will be solely responsible for all applicable local, state, or federal taxes on prizes. Entry materials/data that have been tampered with or altered, or mass entries, reproductions and photocopied entries, or entries generated by a script, macro or use of automated devices are void. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, garbled, illegible or postage due entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any participating retailer's web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify or terminate the Sweepstakes if Sponsor believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper play of the Sweepstakes. If Sweepstakes is terminated before the end date, Sponsor will determine the winners from all eligible entries received as of the termination date. Entry constitutes consent to the use of prize winner's name, voice, picture and/or likeness without compensation for promotion purposes to the extent allowed by law.

6. RELEASE OF LIABILITY: By participating, you release Sponsor, and its parent companies, subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of this Sweepstakes, from and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are not responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize other than as expressly set forth in these Official Rules. By entering the Sweepstakes, you further agree that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to reasonable and actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental, indirect or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for reasonable and actual out-of-pocket expenses.

7. CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

8. WINNERS' NAMES: To receive the names of the prize winner by mail, please mail a self addressed stamped envelope postmarked by 2/29/12 and received no later than 3/9/12 to Club Macanudo Weekend in NYC Winners List, 2589 Eric Lane, Burlington, NC 27215.
